Booth - Terms and Conditions

  1. Your registration for an Exhibition booth signifies your acceptance of the Terms of Use in full and agreement to be bound by these Terms and Conditions, the Terms of Use of the Website, the Privacy Policy Statement of the Hong Kong Arts Development Council (“HKADC” or “we”) and all applicable laws without limitation or qualification. “Exhibition” means the exhibition organised by the “Hong Kong Performing Arts Expo” (HKPAX) during 16–18 October 2024. “Booth” means the exhibition booths and/or common area in the Exhibition Venue. “Exhibitor” means an individual or an organisation whose application to exhibit at the Exhibition has been accepted by HKPAX.
  2. Applications for an Exhibition Booth can only be made through a valid registered user account on the HKPAX official website.
  3. There is a limited quota on Exhibition Booths. Applications will be carefully reviewed taking into account the information provided by the applicants. Confirmation emails will be sent out within one month after the deadline for application. Successful applicants will receive further information and payment instructions to finalise their transaction.
  4. The Exhibitor shall pay the fee within one month of the date of HKPAX’s Confirmation Email.
  5. Discounts will be provided based on specific conditions. For detailed information regarding the eligibility criteria for discounts, please refer to the latest updates on the HKPAX official website. It is important to note that discounts cannot be combined.
  6. For the sake of clarity, HKPAX has full and absolute discretion to allot Exhibition Booths among eligible Exhibitors, including the right to reallocate Exhibition Booths to eligible Exhibitors to other locations other than that which eligible Exhibitors have previously been notified by HKPAX.
  7. Requests to change an Exhibition Booth allotted by HKPAX to the Exhibitor will not be entertained. The Exhibitor’s license to exhibit at the Exhibition and use the allocated Exhibition Booth is specific to the Exhibitor and cannot be transferred, assigned, subcontracted or shared with any third party, regardless of the relationship between the third party and the Exhibitor.
  8. The removal and disposal of booth decoration, exhibit materials and other items brought by the Exhibitors are not covered by the rental. The Exhibitor is responsible for such removal and disposal. The Exhibitor will have no claim against any material apparently abandoned and subsequently disposed by HKPAX.
  9. Fixings to the floor surface to secure booth or exhibit materials are strictly prohibited.
  10. The suspension of booth materials or lighting fittings from the ceiling structure of the Exhibition Venue is strictly prohibited.
  11. HKPAX reserves the right to alter or remove without notice and at the Exhibitor’s expense any booth that does not conform with approved specifications or any stand violating the Terms and Conditions or HKPAX’s required standards. Exhibitors will have no claim against HKPAX for any cost of replacing stands to conform to the HKPAX’s requirements or for any other loss or damages.
  12. Booth decoration must be carried out within the time limits specified by HKPAX.
  13. All materials used in booth construction must be properly fire-proofed in accordance with local regulations.
  14. The Exhibition Booth must always be attended by at least one authorised representative during the Exhibition. The representative should possess thorough knowledge of the Exhibitor’s products and/or services and be duly authorised to negotiate and finalise sales contracts. The Exhibitor is responsible for ensuring that representatives adhere to these Terms and Conditions and follow any instructions provided by HKPAX during the Exhibition.
  15. The Exhibitor must adhere to HKPAX’s arrangements and move into the Exhibition Venue within the specified time limits set by HKPAX.
  16. HKPAX will not provide temporary storage service for Exhibitors’ belongings. There is no designated on-site storage area provided by HKPAX.
  17. All exhibits, exhibition materials, and similar items must be removed promptly after the closing of the Exhibition in accordance with the arrangements and within HKPAX’s specified time limits. Any exhibits or exhibition materials left behind at the Exhibition Venue will be considered abandoned and disposed of by HKPAX at the expense of the respective Exhibitor. HKPAX will retain any proceeds (if applicable) from such disposal.
  18. Unless death or personal injury is caused by negligence of HKPAX or its employees, HKPAX, its employees, agents, representatives or contractors shall not be liable to the Exhibitor, its employees, agents, representatives, contractors or its goods or other property, and for any loss, injury or other damage.
  19. The Hong Kong Arts Development Council will collect your/your organization’s information, which will be disclosed on the HKPAX website and assembled into a list of exhibitors for future internal reference and shared for networking event invitation. You have the right to request for access to and correction of the personal data provided. Please contact us at [email protected] if you have any concerns.
  20. Exhibitors who request a withdrawal of the booth rental, please refer to the latest updates of the Cancellation and Refund Policy on our official website.
  21. HKPAX reserves the right to suspend or terminate booth rentals without compensation or otherwise.
  22. HKPAX reserves the right to modify, reschedule, cancel and/or terminate the Event at any time without prior notice. In the case of HKPAX rescheduling, cancelling or terminating the Event, the Exhibitor may apply for a refund of booth rental according to the refund procedures announced by HKPAX. Handling charges of third-party service providers will not be refunded by HKPAX. No other compensation will be made by HKPAX.
  23. By entering the HKPAX exhibition sites, exhibitors give consent to and confirm that any photo and audio/audiovisual recording made of them during HKPAX (Expo, Exhibition, Showcases, Conversations etc.) may be extensively used free of charge in press coverage as well as in any future promotional applications by HKPAX in all media and a documentary video. It is also agreed that this material may be used for sponsorship acquisition.
  24. The HKPAX community believes in and expects a welcoming, tolerant, diverse and productive environment for all. HKPAX reserves the right to cancel registration due to an objective justified reason, for example offensive and discriminatory behaviour that may endanger the HKPAX operation or image.
  25. In case of infringement of terms and conditions, HKPAX reserves the right to refuse registration, or to cancel your registration and all registration benefits without refund or reimbursement of expenses, and to refuse admission to or expel individuals from event sites.
  26. HKPAX reserves the right to amend these Terms and Conditions or to suspend or terminate the privilege offers at any time without any prior notice.
  27. These Terms of Use shall be governed by and construed in accordance with the laws of Hong Kong. You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
  28. In the event of any dispute in connection with Exhibition and Exhibition booth, the interpretation and decision of HKPAX shall be final and conclusive.
  29. If any provision of these General Terms and Conditions should be invalid, that shall not affect the validity of the remaining terms and conditions.
  30. In case of discrepancies between the English and Chinese version of these Terms of Use, the English version shall apply and prevail for all purposes.
