Terms and Conditions of Exhibition Rentals
- All Exhibition Spots of the “Hong Kong Performing Arts Expo” (“HKPAX”), administered by the Hong Kong Arts Development Council (“HKADC” or “we” or “us”), are subject to these Terms and Conditions. Your application for an Exhibition Spot signifies your acceptance of the Terms and Conditions in full and agreement to be bound by these Terms and Conditions, the Terms of Use of the HKPAX’s official website (“Website”), the Privacy Policy Statement of the Website and all applicable laws without limitation or qualification. "Exhibition" means the exhibition named “Exchange Avenue 交流大道” of the HKPAX during 10-11 October 2026. "Spot" means the Exhibition spot and/or common area in the Exhibition venue. "Exhibitor" means an individual or an organisation whose application to exhibit at the Exhibition has been accepted by HKADC.
- Applications for an Exhibition Spot can only be made through a valid registered user account on the Website.
- By submitting the application, you/ your organisation have declared and warranted that all information provided in the application is correct and will not be amended without our written approval, and that you have agreed to comply with all the conditions set out in these Terms and Conditions.
- You must ensure that the use of submitted materials does not infringe any third-party rights. You shall fully indemnify us and our affiliates against any claims or liabilities arising from non-compliance with this clause.
- There is a limited quota on Exhibition Spot. Subject to actual circumstances, HKPAX reserves the right to amend the application deadline without prior notice. Applications will be reviewed taking into account the information provided by the applicants.
- Confirmation emails will be sent out within one month after the application period closes. Successful applicants will receive further information and payment instructions to finalise their transaction. The Exhibitor shall pay the fee before the payment deadline stated in our confirmation email.
- We have full and absolute discretion to allot Exhibition Spot among eligible Exhibitors, including the right to reallocate Exhibition Spot to eligible Exhibitors to other locations other than that which eligible Exhibitors have previously been notified by us.
- Requests to change an Exhibition Spot allotted by us will not be entertained. The Exhibitor's license to exhibit at the Exhibition and use the allocated Exhibition Spot is specific to the Exhibitor and cannot be transferred, assigned, subcontracted or shared with any third party, regardless of the relationship between the third party and the Exhibitor.
- Fixings to the floor or wall surface and railings to secure Exhibition Spot decoration, exhibit materials and other items brought by the Exhibitors are strictly prohibited.
- The suspension of materials or lighting fittings from the ceiling structure of the Exhibition venue is strictly prohibited.
- All materials used in Exhibition Spot must be properly fire-proofed in accordance with local regulations.
- We reserve the right to alter or remove without notice and at the Exhibitor's expense any Spot that does not conform with approved specifications or any stand violating the Terms and Conditions or our required standards. Exhibitors will have no claim against us for any cost of replacing stands to conform to our requirements or for any other loss or damages.
- The Exhibitor must adhere to our arrangements. The Exhibitor should also move into the Exhibition venue and decorate the Exhibition Spot within the specified time limits set by us.
- The Exhibition Spot must always be attended by at least one authorised representative during the Exhibition. The representative should possess thorough knowledge of the Exhibitor's products and/or services and be duly authorised to negotiate and finalise sales contracts. The Exhibitor is responsible for ensuring that representatives adhere to these Terms and Conditions and follow any instructions provided by us during the Exhibition.
- We will not provide temporary storage service for Exhibitors' belongings. There is no designated on-site storage area provided at HKPAX.
- The Exhibitor is responsible for the removal and disposal of Exhibition Spot decoration, exhibit materials and other items brought by the Exhibitors at the Exhibitor's expense. All such items brought by the Exhibitors must be removed promptly after the closing of the Exhibition in accordance with our arrangements and within our specified time limits. Any items brought by the Exhibitors left behind at the Exhibition venue will be considered abandoned and disposed of by us at the expense of the respective Exhibitor. The Exhibitor will have no claim against any material apparently abandoned and subsequently disposed by us. We will retain any proceeds (if applicable) from such disposal.
- Unless death or personal injury is caused by negligence of us or our employees, HKADC, its employees, agents, representatives or contractors shall not be liable to the Exhibitor, its employees, agents, representatives, contractors or its goods or other property, and for any loss, injury or other damage.
- The HKADC will collect your personal data in accordance with the Privacy Policy Statement of the Website and the relevant personal information collection statements. Your application also signifies your acceptance and consent that your/your organisation's information will be assembled into a list of exhibitors, and may be disclosed on the Website and to other Exhibitors, and used for our future internal reference and for our and other Exhibitors’ networking event invitation.
- To assess the applications and handle related enquiries or complaints, you authorise us to duplicate, distribute, and archive application materials. These materials may be shared with our examiners, Council members, advisors, the Culture, Sports and Tourism Bureau, other government departments, and external consultants for reference and case follow-up. You also agree to authorise us to possess, process and archive application documents submitted by you.
- By entering the Exhibition Spot, Exhibitors give consent to and confirm that any photo and audio/audiovisual recording made of them during HKPAX may be used free of charge in press coverage as well as in any of HKPAX’s future promotional applications by HKADC in all media and a documentary video. It is also agreed that this material may be used for sponsorship acquisition.
- Exhibitors may request a withdrawal of your application or termination of the Exhibition Spot license; however, the Exhibition Spot license fee will not be refunded.
- We reserve the right to suspend or terminate Exhibition Spot licenses without compensation or otherwise.
- We reserve the right to modify, reschedule, cancel and/or terminate the Event at any time without prior notice. In the case of our rescheduling, cancelling or terminating the Event, the Exhibitor may apply for a refund of Exhibition Spot license fee according to the refund procedures announced by us. Handling charges of third-party service providers will not be refunded by us. No other compensation will be made by us.
- Exhibitors must observe the laws of Hong Kong at all times while they are within the Exhibition Spot and other HKPAX venues and event sites.
- The HKPAX community believes in and expects a welcoming, tolerant, diverse and productive environment for all. We reserve the right to cancel applications, terminate licenses and to refuse admission to or expel individuals from venues or event sites due to any objectively justified reason, for example offensive and discriminatory behaviour that may endanger the HKPAX operation or image.
- In the event of any violation of the Terms and Conditions, we reserve the right to refuse or cancel your application and terminate your license without refund or reimbursement, and to refuse admission to or expel individuals from venues or event sites.
- We reserve the right to amend these Terms and Conditions or to suspend or terminate the privilege offers at any time without any prior notice.
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
- In the event of any dispute in connection with Exhibition and Exhibition Spot, the interpretation and decision of HKADC shall be final and conclusive.
- If any provision of these Terms and Conditions should be invalid, that shall not affect the validity of the remaining terms and conditions.
- In case of discrepancies between the English and Chinese version of these Terms and Conditions, the English version shall apply and prevail for all purposes.
